By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these terms, you must not use our services.

Acceptance of Terms

  • By accessing or using StayFit services, you agree to be bound by these Terms and Conditions
  • If you do not agree to these terms, you may not use our services
  • These terms apply to all users including gym owners, staff, and members
  • You must be at least 18 years old to use our services independently

Capacity to Enter Agreement

  • You represent that you have the legal capacity to enter into this agreement
  • If you are representing a business, you have authority to bind that entity
  • You agree to provide accurate and complete information during registration

Service Description

Platform Services

  • Gym management software including member management
  • Payment processing and billing automation
  • Staff scheduling and management tools
  • Equipment booking and facility management
  • Analytics and reporting features
  • Mobile applications for gym members and staff

Service Availability

  • We strive for 99.9% uptime but cannot guarantee uninterrupted service
  • Planned maintenance will be communicated in advance when possible
  • Emergency maintenance may occur without prior notice
  • Service features may be updated or modified at our discretion

User Responsibilities

Account Security

  • Maintain the confidentiality of your login credentials
  • Notify us immediately of any unauthorized access
  • Use strong passwords and enable two-factor authentication
  • You are responsible for all activity under your account

Acceptable Use

  • Use the service only for lawful purposes
  • Do not attempt to gain unauthorized access to our systems
  • Do not interfere with or disrupt our services
  • Respect the privacy and rights of other users
  • Comply with all applicable laws and regulations

Data Accuracy

  • Provide accurate and up-to-date information
  • Regularly review and update your account information
  • Ensure member data is collected with proper consent
  • Maintain backup copies of critical business data

Payment Terms

Subscription Fees

  • Subscription fees are billed monthly or annually as selected
  • All fees are non-refundable except as required by law
  • Price changes will be communicated 30 days in advance
  • Failed payments may result in service suspension

Payment Processing

  • We use secure third-party payment processors
  • You authorize us to charge your selected payment method
  • Keep payment information current to avoid service interruption
  • Additional fees may apply for premium features or overages

Taxes

  • You are responsible for all applicable taxes

  • We do not claim ownership of member data you upload
  • You grant us license to use your data to provide services
  • You may export your data at any time

Respect for Third Party Rights

  • Do not upload content that infringes on others' rights
  • Ensure you have permission to use any uploaded images or materials
  • Report any intellectual property violations to us

Limitation of Liability

Service Limitations

  • Our service is provided "as is" without warranties
  • We do not guarantee error-free or uninterrupted operation
  • You use our service at your own risk
  • We are not liable for data loss due to user error or system failure

Liability Limits

  • Our liability is limited to the amount you paid in the last 12 months

Termination

Termination by You

  • Cancellation takes effect at the end of your current billing period

  • No refunds for partial months or unused time

Termination by Us

  • We may suspend or terminate accounts for terms violations
  • Repeated payment failures may result in termination
  • We will provide reasonable notice when possible
  • Upon termination, your access to services will be suspended

Data After Termination

  • Your data will be retained for 90 days after termination
  • After 90 days, data may be permanently deleted
  • Export your data before termination to avoid loss
  • Some data may be retained for legal or regulatory requirements

Terms Updates

We may modify these terms from time to time. Material changes will be communicated via email or through our platform. Continued use of our services after changes constitutes acceptance of the updated terms.
